This paper defines the Code of Massachusetts Regulations (CMR) and addresses the statutes and regulations contained, that refer to animal shelters. CMR contains regulations enacted by state agencies according to the Administrative Procedure Act (M.G.c 30A). The rules and regulations contained in the CMR constitute the body of the administrative law in conjunction with the administrative orders and decisions. CMR is organized according to the cabinet structure of state government where the first digit usually indicates the cabinet office involved, while the second and the third digit usually specify a particular agency.

The regulations are further broken down in chapters. An example of CMR organization is (301 CMR 11.00 (3) (b) 1.d.) where 3 stand for an environmental agency and 01 stands for Forever Paws animal shelter and the rest are chapters (MacCallum, 2010).

Definition of an Animal Shelter

An animal shelter can be defined as an organization supported by charitable contributions that provide a temporary home for dogs, cats, and other animals offered for adoption. In legal terms, an animal shelter is defined as a public facility for controlling animals or any other facility operated by any organization or individual with function of protecting animals from cruelty, neglect or abuse (MacCallum, 2010).

The CMR of Animal Shelter

Pet and shop licensees are advised to be familiar with the statutes contained in the M.G.L Chapter 129, Section 39A, and the regulations in the Bureau of Animal Health’s on pet shops, 330 CMR 12.00 and ensure compliance with their obligations. While shelters are not regulated by the pet shop statute and regulations, they must comply with other animal laws like the import law and apply all the suggestions in the puppy and dog health protocol (MacCallum 2010).

321 CMR

Chapter 3:00 gives miscellaneous regulations relating to divisions of fisheries and wild life. Regulations under this section focus on the activities related to hunting, fishing, and trapping (MacCallum, 2010).

Guidelines regarding public shooting grounds and wildlife management areas are included in chapter 3:01(MacCallum, 2010). The purpose of this chapter is to govern the administration of wildlife management areas and issue guidelines on the allowed and prohibited activities on such areas (MacCallum, 2010).  It also talks about the definition of hunter orange and give regulations regarding hunting with bows and arrows.

Chapter 3:02 gives regulations regarding hunting of bear. Under this chapter, an annual season of hunting of black bear in Massachusetts is established. Apart from giving regulations regarding migratory game birds where the annual open seasons for the hunting of certain migratory game birds are adopted, it also gives regulations regarding hunting and trapping of certain mammals like bobcat, foxes, and coyotes (MacCallum, 2010).

Special regulations regarding wildlife management areas are given in chapter 303. The wildlife management areas included in this section include: Delaney Wildlife Management area in the towns of Show, Harvard, and Bolton in Massachusetts, North east wildlife management Area, Ludlow, J.J Kelly, Flint pond and Westborough wildlife management areas (MacCallum, 2010).

Regulations regarding falcons, other raptors and falconry are discussed in chapter 304. Here regulations regarding application and examination requirements for pens and shelters are provided. The regulations states that indoor facilities (mews) should be large enough to allow for easy access for caring for the raptors housed in the facility (MacCallum, 2010).

 It also provides for protection of the birds through fencing. Protection of the birds against excessive sun, wind, and inclement weather is also provided for in this chapter of the codes. Regulations under this chapter further states that major change of existing facilities must be reported to the Director as completed and adequate perches be provided to the birds. Minimum facilities under the Raptor Propagation and/or Salvage permits shall be as established by the Director after due consideration of the individual breeding and/or rehabilitation program to be conducted by the applicant (MacCallum, 2010).

Chapter 304 further  provide guidelines regarding inspection, capture limitations, species and possession limits, equipments, lost raptors, transportation, hunting limitation, revocation of permits,  Federal falconry regulation, Annual activity report and marking of the falcons. While in chapter 305, there are guidelines regarding hunting, fishing, trapping, and taking of reptile and amphibians in all the countries of Massachusetts (MacCallum, 2010).  It also gives guidelines about species to be hunted.

Chapter 6:00 gives guidelines about dog restraining order. It states that any person owning, keeping or possessing a dog or dogs shall restrain those dogs from loitering in the city or towns mentioned in the CMR. It also advises those having dogs to prevent them from chasing, harassing, hunting, molesting, attacking or killing deer (MacCallum, 2010).

Wildlife sanctuaries are provided for in chapter 7:00. This chapter governs the administration of wildlife sanctuaries and prohibited acts within the geographical boundaries of those areas, whereas chapter 8:00 provides for the official state list of endangered, threatened and species of plants and animals which are of special concern (MacCallum, 2010).

Guidelines regarding the exemption list are contained in chapter 9:00. The purpose of this chapter is to list all the species which are exempted from licensing requirement, and which may be imported, possessed, maintained propagated bought, sold exchanged or offered for sale without a license or permit from the Division (MacCallum, 2010).

Chapter10:00 gives provisions for the regulations contained in the Massachusetts Endangered species Act (MacCallum, 2010). Part one of this chapter talks about the general provisions, definitions, listings permits and the responsibilities of state agencies. Part two talks about the delineation of priority and review of projects or activities within the priority habitat. Part three talks about the designation of a significant habitant. Part four talks about the alteration of a significant habitat while part five gives a species list and designated significant habitats. In summery this section governs the implementation of the endangered species in Massachusetts.

Chapter 11.00 talks about nature preserve (MacCallum, 2010).  It has a purpose of establishing a system of dedicated nature preserves and for guiding the division of fisheries and wildlife in defining the criteria, scope, protocol and stewardship for the dedication and management of the reserves.  Rehabilitated injured wildlife have to be released (with few exceptions) at a location within five miles of the point of capture, or within the same county to which the facility is permitted ( MacCallum, 2010).

Although 321 CMR covers widely the regulation involved in the administration of animal shelters, other regulations on animal shelters are included in 314 CMR which states that any warm or cold water aquatic animal production facility requires a permit ( MacCallum, 2010). Regulations relative to the vaccination of dogs and cats against rabies is contained in 105 CMR330.000, while rules governing prevention of the spread of rabies is contained in 330 CMR 10.00.


The provisions in the 321 CMR slot in an idea that proper management of wildlife resources of commonwealth is important for the preservation of all forms of wild life so as to capitalize on the ecological balance and genetic diversity of the environment. It can also be concluded from this paper that the regulations contained in the CMR set standards for public health and safety.

Apart from that, it also set standards for licensing of professionals, and offers protection consumers and the environmental. It provides guidelines about examination of dogs and puppies when they arrive at the shelters and when they show signs of a disease. Guidelines regarding provision of veterinary and routine care are also provided by the regulation and rules contained in the CMR.

A society’s importance and strength is often measured through number of contemporaries. This is no theory; we always give a notion of power and importance to majority. In the same way, we pay high respect to this certain group of individuals who are regarded as professionals in different forms of discipline.

Knowledge Management Professionals is an organization of combined professionals aiming to promote the use of knowledge in order to provide better decisions and organizational outputs. It sheds a new light of a society’s existence – that is through quality rather than quantity of members. In order to come up with quality outputs, a certain division of values has to be followed. This is what we call code of ethics.

For a group of professionals, it is very critical to propose a code of ethics that is true to all forms of disciplines. However, since most professionals are in service industries, effective performance should be the first rule. This rule will continuously lead them to function as their profession effectively. Apart from it, good attitude is also recommended. Without good attitude, relationship with ordinary people will never grow. These ordinary people may be less educated unlike professionals, but they know the kind of leaders/professionals they want because, just like everyone else, they also want to improve their quality of lie. Without the presence of good attitude among professionals, it will cancel each other out and in the analysis, undermines what service is supposed to be, that is, quality service.

Aside from the performance and attitude, their commitment is also an important element. Their commitment should be something personal in them and is an integral component of higher sense of professionalism. But again, the fact that these professionals already have their respective licenses and titles, it simply means that they are competent – competence that has to be true to all.

Why We Need Code Of Ethics


American professionals in the media need a code of ethics as a measure of ensuring that; the professionals uphold privacy, confidentiality, honesty, impartiality and trustworthy to the society in the process pf disseminating information and coverage of events.


A code of ethics for the professionals in the media is important in regulating the conduct of the media professionals.  The code of ethics will guide the professionals in the media and therefore make sure that all ethical dilemmas can be resolved amicably.  The code of ethics is useful in making sure that the values of the professionals are in agreement with the expectations of the society.  A code of ethics will ensure that the professionals in the media do not conflict with the society as the professionals become more aware of the limits to which their activities can go.

A code of ethics is important in that it specifies the ethical responsibilities of the media professionals something, which is meant to minimize any dilemmas that come whenever professionals act in contravention of the code of ethics (Gordon, et al. 1997).  The code of ethics for media professionals is designed so as to ensure that any issues facing the professionals and is likely to impact on the American society is taken care of.  In addition, the code of ethics is more of guidelines, which specifies the extent to which a professional can go especially in regard to news, or reporting of a given event.  The professionals’ code of ethics for the media professionals is also meant to protect the actions of the professionals from harming the American society.  The activities of the media professionals can greatly harm the society unless they are well regulated.

For the media professionals, honesty and trustworthy is indispensable.  The media professionals must always ensure that they are consistent and fair in their coverage otherwise they risk losing credibility.  This is why a code of ethics is very central to the functioning of the media professionals.  It is very hard for the professionals to ensure honesty and trustworthy unless there is a code of ethics to regulate them.  Trustworthy is very important to the media professionals in that, unless the media professionals are proved to be beyond reproach, their job will be unappealing  to many, something which presents a great challenge to the professionals (Gordon, et al. 1997).  In addition, honesty and trustworthy are key tenets of media practice especially given the fact that for a very long time, the media in the United States has been blamed for presenting unbalanced news especially when it comes to issues on human rights such as racial discrimination.

The code of ethics stipulates what a professional can or cannot do.  This has ensured that, they remain professional and committed to their duty in honesty. Therefore, the code of ethics and its adherence has seen great importance in bringing forth balanced news by the professionals in the media.  In addition the code of ethics has ensured that the media professionals understand that, it is their duty to serve Americans in honesty and trustworthy.  The actions of the media professionals can build or break a nation.  It has happened in other countries.  For instance the 1992 Rwanda massacre was partly ignited by a largely biased media profession, which never gave credence to the media professional code of ethics.  As a result, the professionals became tools of igniting the ethnic turmoil, which went ahead and contributed to one of the world’s recent humanity catastrophes.  Therefore media professionals’ code of ethics is very important in making sure that media professionals do not degenerate into agents to selfish goals.  Unless the media professionals are keen on observing the media code of ethics, the danger of harming the American society will be real.

Inorder to make sure that the media professionals’ activities are not harmful to the American society, it is therefore paramount for every single media professional to respect the media professionals code of ethics.  Other negative consequences, which can result from failing to adhere to the code of ethics, may include the misinformation of the public especially on key issues such as; global warming which are currently dominating the public debates.  It must be noted that the media exists to inform, entertain and educate.  As such; the media professionals are supposed to operate within the precincts of the media professionals’ code of ethics.  Media professionals therefore are supposed to unify the society and positively contribute to the well being of every American citizen.  Therefore the media professionals have a duty to adhere to their professional code of ethics if the above mission is to be adhered.  Unless the media professionals are keen on concerning themselves with the social needs of the society, this is likely to result in hurting of the American society as opposed to unifying it.

Therefore a code of ethics is important in as far as ensuring that the diverse cultural background of American society is upheld.  The activities of the media professionals may hurt the cultural diversity if the media professionals fail to adhere to the code of ethics.  The media professionals are supposed to be fair and indiscriminative.  The best way to achieve this goal is by making sure that the media professional code of ethics is upheld at all times.  The code of ethics binds the professionals into respecting the society members and as such the professionals are barred from showing bias on basis of; sex, colour, social class, nationality, religions or political ideological orientation.  With a good media professional’s code of ethics there is a guarantee that the activities of the media professionals will be fair to every American society.

The media professionals’ code of ethics is important in that it guides the professionals in their activities and ensures that media professionals are able to observe and honour rights of the citizens. To media professionals, equally important are the property rights, which bar them from mishandling information.  This is well stipulated by the media professional code of ethics.  The media professional code of ethics is important in that it guides and protects the media professionals from compromising and hurting the career lives and not only from the harming of the society. The code of ethics is also important in that it ensures that the media professionals are able to respect the privacy of the American citizens.  Unless well guided, media professionals can easily infringe on people’s privacy especially out of the desire to get the best and captivating news.  Therefore the code of ethics ensures that, media professionals are well regulated and do not go beyond limits and infringing the privacy rights of people

The media professionals must uphold integrity and avoid any practices, which harm citizens.  In addition, the media professionals are able to maintain confidentiality especially in regard to the source of information.  Some information is sensitive and failure to observe confidentiality on the part of the professionals is likely to be harmful.  Inline with the goal of media professionals to provide fair coverage of events, the professionals are required to be very dedicated to ethical behaviour.  It is the media professional code of ethics, which outlines the specific, rules which unless observed the media professionals cannot claim to behave ethically.  Therefore, the code of ethics is important to media professionals in that it ensures that the professionals uphold American’s beliefs and standards (Herbert, 2002).   The American media professionals are answerable first and fore most to the American public. As such the code of ethics is especially important in empowering the professionals to function independently.

This sense of independence accorded to the media professionals by the code of ethics makes it possible for media professionals to function professionally.  The code of ethics for media professionals ensures that the media professionals are accountable to the profession and to the American public. It is therefore paramount, that the media professional code of ethics is adjusted to fit into the expectations of all those who are served by the media professionals such as readers and viewers (Keeble, 2001).


American professionals in the media need a code of ethics as a way of ensuring that the professionals are able to offer fair and justifiable services to the American public.  The code of ethics regulates the activities of the professionals and therefore ensure that the media professionals act and function in accordance to the call of their professional and to the satisfaction of the society.
